MKP Gym – Terms and Conditions

1. Introduction

These Terms and Conditions govern the use of the website and facilities of MKP Gym (“we”, “us”, “our”). By creating an account, purchasing credits, booking sessions, or using the gym facilities, you agree to these Terms and Conditions.

If you do not agree to these terms, you must not use this website or the gym facilities.

2. Eligibility

To use MKP Gym services you must:

  • be at least 18 years old
  • be legally capable of entering a contract
  • provide accurate account information

MKP Gym reserves the right to suspend or terminate accounts that provide false information.

3. Self-Service Gym Facility

MKP Gym operates as a self-service private gym facility.

Members acknowledge that:

  • there may be no staff or trainer present
  • users are responsible for safe and proper use of all equipment
  • users must follow all gym rules and safety guidelines

Members use the facility at their own risk.

4. User Accounts

Users must create an account to access certain services including:

  • purchasing credits
  • booking training slots
  • managing reservations

Users are responsible for maintaining the confidentiality of their login credentials.

MKP Gym is not responsible for unauthorized account use resulting from user negligence.

5. Booking System

Training sessions may be booked through the website booking system.

By booking a slot, the user agrees that:

  • the booking reserves exclusive access to the gym for the selected time
  • bookings must be made through the official booking system
  • double bookings or misuse of the system may result in account suspension

MKP Gym reserves the right to cancel bookings in case of:

  • technical issues
  • facility maintenance
  • safety concerns
  • force majeure events

6. Credit System

Gym access may require the purchase of credits.

Credits may be used to book training sessions.

Important rules:

  • credits are non-transferable
  • credits may only be used by the registered account holder
  • credits may have expiration dates if specified at purchase

7. Payments

Payments may be processed through third-party providers such as:

  • PayMongo
  • Credit or debit card processors
  • Digital wallets (e.g. GCash)

MKP Gym does not store payment card details.

All payments are processed securely by third-party payment providers.

8. Refund Policy

Unless required by law:

  • purchases of credits are non-refundable
  • unused credits are not redeemable for cash
  • refunds may only be granted in exceptional cases at the discretion of MKP Gym

9. Cancellation Policy

If a booking cancellation policy is implemented:

  • users must cancel bookings before the required deadline
  • late cancellations or missed bookings may result in credit loss

Specific cancellation rules may be defined in the booking system.

10. Gym Rules

All members must follow the gym rules, including but not limited to:

  • use equipment responsibly
  • clean equipment after use
  • return weights and equipment to their designated places
  • do not misuse equipment
  • respect time limits for booked sessions
  • maintain appropriate behavior

MKP Gym reserves the right to terminate memberships for rule violations.

11. Damage to Equipment

Members are responsible for damage caused by:

  • misuse of equipment
  • negligence
  • violation of gym rules

Members may be held financially responsible for repair or replacement costs.

12. Security Cameras

For safety and security purposes, the facility may use video surveillance cameras.

By entering the gym premises, members acknowledge and consent to such recording.

13. Limitation of Liability

To the maximum extent permitted by law, MKP Gym shall not be liable for:

  • personal injury
  • property damage
  • theft or loss of personal belongings
  • accidents occurring within the gym facility

except in cases of gross negligence or willful misconduct.

14. Website Use

Users agree not to:

  • attempt unauthorized access to the website
  • disrupt website functionality
  • misuse booking or payment systems

Violation may result in account termination.

15. Force Majeure

MKP Gym shall not be liable for failure to provide services due to events beyond its control including:

  • natural disasters
  • power outages
  • government restrictions
  • technical failures
  • emergencies

16. Changes to Terms

MKP Gym reserves the right to update these Terms and Conditions at any time.

Changes will become effective upon publication on the website.

17. Governing Law

These Terms and Conditions shall be governed by the laws of the Republic of the Philippines.
